Workers comp – what are you rights?

work-injury.jpgOur new organiser Linda Morich has spoken to members about workers comp and noted there is a lot of confusion, so she has outlined the process/your rights under the state compensation law. 

  • You have a right to choose your own doctor. Do not let anyone from the company into your medical appointments.
  • You have a right to choose your rehab provider.
  • You have 12 months from the day of injury in which to submit your compensation claim. However, you should inform the employer of the incident as soon as you are able.
  • Your employer and insurer have 17 days to give you a claim response: yes, no or pended awaiting more evidence. f you receive a rejection or no decision to the acceptance of your claim you should call the Union ASAP. When you receive a letter from the insurer asking if you wish to “elect” into common law you must call the union ASAP. This letter is time limited and even if you don’t wish to elect we can lodge an application through the lawyers to extend the time frame to decide.
